Legal Separation
Legal separation is similar to a divorce. It requires many of the same procedures. A couple of differences are:
You can not get remarried after you have obtained a legal separation.
You do not need to live in California for any period of time to file for legal separation.
Community property rights terminate in a legal separation case.
The court cannot grant a legal separation decree if one party objects. If in fact there is an objection, the courts will hear the case as a divorce case.
The grounds of obtaining legal separation include a finding that a marriage is either irretrievably broken, or that either party desires to live separate and apart from each other.
